T-Mobile USA Capped Unlimited Data Plan Leads to Lawsuit

When you get an unlimited data plan from a carrier you anticipate unlimited to mean exactly that and not be capped, but many carrier are now capping data usage on unlimited plans. This has lead to a Californian smartphone user filing a class action lawsuit against T-Mobile USA.

According to an article over on the Boy Genius Report by Andrew Munchbach, by way of Consumer Affairs, the user became upset with T-Mobile USA when he receives a massage from T-Mobile which said…” Your data usage in this billing cycle has exceeded 10GB; Data throughput for the remainder of the cycle may be reduced to 50kbps or less.”

After which the user sought legal advice and a class action lawsuit was filed. The lawsuit claims that the plaintiffs smartphone has become “virtually useless” since the data speeds where capped and the owner is now stuck with a two year contract with the “not-really-unlimited” smartphone provider.

It will be somewhat interesting to see just how this class action lawsuit turns out because if the plaintiff wins the case it could lead to a tsunami of other lawsuit as in the US several carriers push “unlimited” data plans which in reality carry a cap.
